HIPAA Notice

THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU AND YOUR PATIENTS MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.

Our Commitment to Privacy

Cogniscan is committed to protecting the privacy and security of Protected Health Information (PHI) entered into the Cogniscan platform. We are required by law to maintain the privacy of PHI and to provide you with this notice of our legal duties and privacy practices with respect to PHI.

How We Use and Disclose PHI

As a Business Associate to you, the Covered Entity, we may use and disclose PHI for the following purposes:

  • To Provide Our Services: We use PHI to operate the Cogniscan platform, including processing assessments, generating results, and storing data on your behalf.
  • For Health Care Operations: We may use PHI for our own management and administrative activities, such as quality assessment, security analysis, and customer service.
  • Business Associates: We may disclose PHI to our third-party service providers that perform functions on our behalf, such as data hosting. We utilize Google Cloud Platform for our infrastructure, and we have a Business Associate Agreement (BAA) in place with Google, which requires them to safeguard the PHI they maintain on our behalf.
  • As Required by Law: We will disclose PHI when required to do so by federal, state, or local law.

Your Patients' Rights

As the Covered Entity, you are responsible for managing your patients' rights regarding their PHI. The Cogniscan platform provides tools to help you fulfill these obligations, which include the right to:

  • Inspect and copy their PHI.
  • Request amendments to their PHI.
  • Receive an accounting of certain disclosures of their PHI.
  • Request restrictions on how their PHI is used or disclosed.

Our Responsibilities

Cogniscan is required to:

  • Maintain the privacy and security of PHI.
  • Notify you following a breach of unsecured PHI.
  • Abide by the terms of the notice currently in effect.

We reserve the right to change the terms of this notice and to make the new notice provisions effective for all PHI we maintain. Should our notice change, we will provide you with a revised notice.
